I just read the minutes and they are absolutely mind boggling. For those that don't have access to the UK NOC the gist of the minutes are that Les Emery wrote to the NOC threatening them with legal action as they were carrying an advert from Andover Norton that had the word Commando prominently. This resulted in the NOC having to take legal advice that cost almost £600. The legal advice seems to be that Norvil have no case against the NOC as it is not their advert, it is AN's advert.

You really do wonder what planet some people are on and what they hope to gain by taking legal action against an owners club that probably counts a large number of their customers in it's membership.

Bloody Nora! I've already made it policy not to do business with that man, this only makes me more determined.

Maybe it’s sour grapes because the NOC didn’t buy him out a while ago?
 
Mr.Emery registered a trademark "Commando" in the early 1990s, when Norton belonged to the Canadian "absentee landlords" who did not care. Obviously to stop others from using the word "Commando" in advertizing Norton spares.
He overlooked the fact Andover Norton, then his main source (not any more- I cancelled his trade account with us on 1st October, 2012), was trading in, and advertizing, Norton Commando spares since 1977, i.e. years before he even opened his first shop, so had contiunuous use before his pirate registration. So have many others, Mick Hemmings comes to mind.
Emery has tried to threaten us directly and I told him he had no case.
He then had at least two goes at "Classic Bike" and the NOC. They are "soft" targets in that a) he advertizes in them, so is a source of income, and b) they do not want to get involved. Both parties were getting excited until we explained the legal background.

Why the NOC in their infinite wisdom continue to support Emery by publishing his adverts and ramblings and by buying most parts for their Spares Scheme from him I do not know. But then that does not, fortunately, concern us any longer.
 
Les Emery has once again proved what sort of a person he really is. A total *****r.
It's a pity that his name is associated with Norton's and he is often referred to as a "Norton guru" in the classic motorcycle publications, and although I don't doubt he has considerably more "Norton knowledge" than me, his attitude towards his customers and overall contribution in recent years to the marque leave a lot to be desired.
Reading the latest pettiness makes me feel quite angry.
I haven't bought anything from him since 2009.
 
It's sad really, the thing that worries me is if you were new to Norton ownership and you used his shop it would put you off for life, before I realized what he was like I bought parts from him needless to say they weren't usable as they were,a phone call produced a barrage of abuse stating I had fitted it wrong etc but in the end he agreed that they had sent the wrong parts,I sent the parts back it took 3 months of phone calls to get the right parts , never ever again
 
A friend restoring a 1974 Mk 2A has just ordered parts through the UK NOC, where do they get their parts from, do they have NOS
available ?

The NOC Spares Scheme have some NOS but most popular parts they source from Emery. They buy nothing from Andover Norton even though we repeatedly talked to them and offered them a trade discount for their purposes.
"Genuine" can, by definition, only come from us.
 
Hard to understand why the NOC continue to buy parts from someone who threatened them with legal action and cost them almost £600.

I'm only guessing but L.Emery probably has a couple of NOC committee members "in his pocket" as it were.
I'm a NOC member, I'll be having words with our branch secretary about this and make appropriate suggestions.
 
I am an NOC member too and have used the contact us facility to ask if they buy parts from Norvil and if so, are they going to continue to do so after the threat of legal action. Be interesting to see if I get any reply.

Let me get this straight...

Emery threatens the NOC for using a Commando name, that he has not right to do so. The club were using this name to sell parts to members... that are supplied to the club by him...!?

What, precisely, was he trying to achieve ?

He was objecting to AN using 'Commando' in their Roadholder advertisements.
 
If you can find the registration application for 'Dominator' in Canada, it is somewhere on the web dated about 2004 if I remember correctly, you'll see that there was an objection logged as 'in bad faith' it was our Emery who logged it - this was after the time he registered Commando (in bad faith)

Says it all really, armed with this how the hell could defend his registration of Commando! strangely it looks like he never will as he knows he will lose it.
