Norton trouble

Spare a thought for owners who have their 961s at Norton now having warranty work done! my friend being one of them.
Regarding pensions,could he end up in debtors prison.

Well, they have nothing to do with the sad state of affairs and I feel sorry for them.

Though rational thought should have told them the collapse was but a question of time, the whole exercise being the caricature of a motorcycle factory.

I have been inside some, including small ones that actually put out working product that didn't come back like boomerangs. MV Agusta, CCM and Gerry Lisi's Rickman come to mind.

With a valid V5 current owners will have no issues getting their bikes back, question will be is the warranty work done, the warranty commitment will die with a bankruptcy, not sure on administration but as it must be the intention to carry on trading then for now that should continue.

The problem comes with the bikes in production and paid for partially or completely, this will be governed by the Sales Order T&C's, this should state at what point ownership moves from Norton to the Purchaser. Sticking points will be if a complete bike has been paid for, ownership has passed to purchaser but the bike is not finished. This could get very complex. At the worst you become a creditor, but I suspect well down the list and the debt only worth pennies in the £, the Tax man and Metro bank will head the list of creditors.

Anyone in the business know what happens in this situation - what happens to assets/ bike orders/ part orders customer
So is Andover going to pick up the spares business and or completing bikes for the administrator? If I was a "modern" Norton owner that is what I would hope for. Unfortunately, having some knowledge of bankruptcy and "restructuring" in the US I doubt that will be the outcome.

Spoke to Andover and they are literally dancing on the grave of Garner's Norton Motorcycles. No love lost between them but too early to conjecture on spares supply. Could they pick up some existing stores items?

I have paid a deposit or made payment in full in respect of my order. What can I claim?

¡ You will be contacted by the Company either by phone or email and they will inform you on the current status of your order.

¡ If goods are not delivered you may claim for amounts to the value of your order you may have paid.

I no longer wish to continue with my order. Can I obtain a refund?

¡ The Administrators are reviewing the position and these will be dealt with on a case by case basis. If you wish to cancel an existing order please email NMComms@BDO.co.uk, heading your email “Order Cancellation”. Please include full details of your order in the email. This will then be checked and someone will contact you to discuss.

My order has been dispatched but I have not yet received it. What should I do?

¡ If your order has been passed to the delivery Company for delivery you should await delivery. In the event that you do not receive your order within the prescribed period please contact the Joint Administrators at NMcomms@BDO.co.uk with full details of your order and you will be contacted with an update as soon as the position has been clarified.

I have placed an order but not yet paid. Will the order be fulfilled?

¡ If your order is able to be fulfilled, you will be contacted by the Administrators to ascertain whether you would like to proceed and to confirm the terms and conditions of sale.

The Company has informed me that it is unable to fulfil my order. How can I claim any monies paid?

¡ Customers should contact their bank/credit card provider or Paypal to obtain refunds (see later in this document for further information).

¡ If you are successful in claiming against your credit / debit provider you will not be able to make a claim against the Company. The credit / debit card provider will make a claim instead to the value they have paid you.

¡ If you have paid by cash or cheque or the above options are not available, customers may make a claim against the Company as an unsecured creditor. To do so please contact the Joint Administrators at NMcomms@BDO.co.uk to inform them of your claim.

I have paid on my credit / debit card or via Paypal, how should I claim?

¡ If customers have paid a deposit for goods by credit or debit card or via Paypal and the goods are not going to be received, you may be able to get your money back by claiming a refund from your card issuer.

¡ If you think this may apply to you, you should make contact with your card issuer as soon as you can to understand what financial protection you may be entitled to.

¡ Further information (including time limits that apply) is available from the UK Cards Association, a consumer guide can be found at www.the ukcardsassociation.org.uk.

¡ The contact number for your credit or debit card issuer may be located on the reverse of your card (otherwise it can be found online). I wish to make a warranty claim against the Company for goods I have purchased from the Company. How do I do this?

¡ The Administrators are reviewing the position in respect of warranties and these will be dealt with on a case by case basis.

¡ If you wish to make a claim under a warranty please email NMComms@BDO.co.uk, heading your email “Warranty claim”, providing contact details and a description of the matter to be dealt with under warranty. The position will then be reviewed and a full response provided.

How will the Joint Administrators update me about my claim?

¡ The Joint Administrators are required to report to creditors during the course of the Administration. This report will include an update on the progress of the Administration and the likelihood and quantum of dividends to creditors and also an estimate of the timescale to pay a dividend, if applicable.

¡ Creditors will receive a formal notification of the Administration which will include how customers can register to receive alerts of reports from our portal.

¡ Please also note that statutory reports for the Company will also be filed at Companies House.

I have a finance agreement in respect of the goods I purchased. What should I do?

¡ You finance agreement is between you and the finance Company. The agreement is not with the Company.

¡ If you have any queries regarding your agreement you should contact the finance Company direct to discuss the matter.

Outstanding monies - If you are owed money by the Company at the date of Administration you may have an unsecured claim against the Company. A letter will be sent to all known creditors explaining the current position and the steps you should take.

Not having been in business myself I really don't understand the legal implications of all this.
I'm just wondering, where does all of this leave SG?

Is he now no longer in control of Norton legally, no longer CEO?
Is the company's fate now completely in the hands of others.

Depends on the administrators but more than likely he is toast and has no further involvement.

The administrators were appointed by Metro Bank who have a charge over the company assets, they and the Taxman get their money first, the administrators always get their hefty pound of flesh leaving the rest the unsecured creditors with pennies in the pound.

What are the options, if any, for the company?

1. Sale as going concern.

2. Assets only being sold but in one piece so production can restart.

3. Assets sold in bits and pieces with not enough in one persons hands to restart.
 
Those are all good questions . I am still in shock that after 10 years of production Norton is now on the brink of failure. Where did it go wrong ? Should have focused on Commando 961 and not the V4 , get that right first I suppose . Keep the base happy so to speak . If the 961 was sorted , just think how many they could have sold ?? Fear is what kept new customers away . I am sad .
 
If I was your friend I would get up to Donnington pronto and recover his bike.

As the administrators have locked the site down he'll need a Mission Impossible style recovery operation........


I've informed them that my bike is there - it is silver with the name McGuinness on it. They have probably taken the number plates off for servicing.......
 
Triumph could pick this up and move production to Thailand or Royal Enfield then production in India. I doubt anyone else will buy and and try to maintain production in the UK, least of all where it is. BDO would bite anyones hand off that offered £10M right now I bet unless SG has squirrelled off some TM or IP ownership.

Yeah Tony I agree.
If you intend to be a low volume boutique manufacturer of a classic design, focus on that - UNTIL YOU GET IT RIGHT.
Don't get involved in racing, or squandering badly needed capital on new designs, that will also need testing and development.
Look at the Morgan company. They make a classic auto for a small but very loyal community of owners.
They don't make supercars, or SUVs, or anything else.
I was hoping something like this was what SG was planning.
His vision was hopelessly over ambitious, and unrealistic.
Too many irons in the fire.

I have made the Administrators aware of your enquiry and they are in the process of reviewing the position in respect of the bikes in for service. The site has been secured by the Administrators and as soon as they have an understanding of the servicing position, you will be contacted to confirm the extent of the works completed and how you can arrange for the collection of the bike. This will need checking, if you have a tracker on the bike text it. One owner has found his bike was on the move over 100 miles away.
