My son is gonna need a lawyer in Cheyenne

Bummer of a couple days here out in the Atlantic.
My son was blindsided by an uninsured motorist while riding his Sportster home from work in Cheyenne, Wyoming.
He's pretty banged up but thankfully will survive. His main injury was a protruding fracture to his lower right leg. A few other nicks and tears to go along with it.
Despite all my and his mothers council there was no helmet so his face and lips took a beating.
He will survive and believe me I understand I am a lucky father to not have worse news.
He is going to be out of work for three months while his new steel rod helps mend his leg back together.
His bike is in rough shape as well but fortunately it was a low speed crash so will probably be resurrected. Still to be determined.
Where do we go from here. I've been riding for 30 years and have never had a crash other than a layover in gravel.
We have medical insurance that covers him but they will soon be calling to ask if anyone else was involved in the accident.
I am assuming he will need a lawyer to help recoup some or all of the costs associated or to at least council him on his options.
Any input form the assembled masses would be greatly appreciated.
Anybody know a good lawyer in Cheyenne?

You MAY!! (CAUTION, I AM NOT A LAWYER, I AM A GEOLOGIST) not need one.
Talk to your insurance and listen for the word "subrogation", they will pay for everything and then bill the other guy's insurance.

A Lawyer of your own, looking out for his interests might be a good idea though and on this side of things I reccommend the sleaziest, Yellow-pages, ambulance-chaser you can find. If you can find one that is 1/2 Jew and 1/2 Snake, all the better!

I think that those are great-traits to find in your Lawyer, I have been in this position before and (in my opinion) you want an aggressive Lawyer!

I have lived in 4 countries, travelled and worked in many many more and I can assure you that a persons character traits, good or bad, have nothing whatsoever to do with sex, religion, age, nationality or any other generalisation.

If something is a flimsy piece of crap I am not going to say that it is "structurally deficient and requires re-engineering", if folks are waiting for me to apologise for who I am get comfy as you have a long wait!

It makes NO difference to me what someones Religion is or is not, that statement got my point across and I stand by it.

Actually 30 years working North Sea rigs, NZ, Maui, Pohokura. Plus oil fields in Venezuela, Thailand, Indonesia, Phillipines, Middle East and Central Asia.

Worked with Christians, Jews, Moslems, Buddists and probably many more. Only generalisation I will make is that you can find idiots everywhere!
 
Ok, setting aside all the rancor and getting back to the issue at hand, He was hit by an "uninsured driver". Providing your son had coverage for uninsured and underinsured drivers, his Insurance will cover the bulk of the costs. The insurance company will definitely go after the uninsured driver that hit your son and sue to try to recover costs over the accident. If the guy owns any property they will lien it. They are tenacious and will never go away.
The problem as I see it goes to the level of coverage your son had and the limits in his policy. The Insurance Company is only required to pay to the limits stated in his policy. With Hospital bills and being out of work for an extended period, it will be very expensive and will probably max out quickly.
I think it is a very good idea to at least have a consultation with a lawyer. There are many out there who represent motorcycle riders in similar actions. Do an internet search, ask for references, Check out their ratings on Martindale. Get prepared.
Best of luck with this and I am hopeful for your son's speedy recovery.
 
There is nothing good in this thread except the news that Jeff's son will be okay.

(this from a 3-time victim of uninsured "motorists" before learning how priceless uninsured motorist protection is)

When one places one's seat in a saddle this is the risk one is always exposed too. Last week's Tee-Bone in our area killed the rider doing and wearing everything right. The folks whose goats got me had no insurance, I had to do a private deal with them. One trick of zionionist liars, er lawyers, it to get themselves involved in fake liens so any new claims gotta wait on the old ones 1st, even if its the IRS. A season out of work and lost cycle are the mild initial results of spinal injury, which your sons does have - with face and head injury evidence, so spine wears out a lot faster to cause delays and complication of the local injury and then decays to cause most of what we associate as mere old age problems. Find a DC that teaches how to regrow neck so there's a long future after getting over the acute phases of this road fate event.

I agree this really isn't the place for derrogatory remarks and stereotypes. I think we are all here to share information on riding and fixing up our bikes. I just think it degrades the whole site. I am not PC and am often too outspoken in my views as well but I think we can do without it. It serves no purpose. Nuff said.

The first thing to check is how much his "uninsured" coverage is . The basic is $30,000.00 and it goes up to 300,000.00 for $20.00 more a year....
Hate to do this, speaking of myself, but when I was hit by the ducati guy, who was under insured (same and part of the un insured policy), I had to take a lawyer not only to get the money but mainly to fight my medical insurance who wanted a huge amount of this settlement ! I paid 1/3 of the settlement to the lawyer but had to pay only $5000 to Kaiser (they wanted $180,000.00...) total medical bills were over $1M billed (everything was over charged as usual and part of the lawyer leverage was proving it too!).
If you have the energy, time & knowledge you could certainly tackle this yourself, is it worth it?

Regarding the racist remark... I did not think this list would sink that low...

xbskt, I would say definately get a leagal eagle lawyer ( regardless of their race, creed, religion etc...). I was in a car on the interstate and was rear ended at reasonably high speed as the traffic in front of me stopped and the guy behind me didn't. He presented the cop at the scene with an insurance company card, so he didn't get a ticket for being uninsured. But later it turned out that he'd paid once on a policy just to get the card then stopped paying. It took more than one year, but I would have been out of pocket for everything if I hadn't gotten the attorney ( he ended up sueing MY insurance company and winning) then it was up to the insurance company to go after this guy for the money they paid out to me to replace my car and cover my expenses. Did he have uninsured motorist coverage? If so, everything should work out fairly well, although his premiums may suffer a rise.
