I was pushed off the road this afternoon at 70mph by an oncoming truck who decided he wanted all the road on a gentle bend , man they look big coming straight at you on a bend, off the road into the grass down for a slide and a tumble.Forks, tank , bars all bent again, straightened it up as best I could and headed home, 70km away, 30ks from home catch up with the truck, still using all of the road, he refuses to pull over, pass him, stand in middle of pedestrian crossing he has to stop,no stop, hurl $700 helmet at his window, now he stops, refueses to get out of his truck, and resists being dragged out, big truck goes nowhere when angry motorcyclist has his keys, police arrest angry motorcyclist and charge with assault :cry: :| :?
 
Yes you are alive and angry and not thinking clearly after the event. Understandably so. Unfortunately yes those actions are seen as assault. I am not a lawyer but you will be knowing one but soon. Remaining at the scene of the accident recommended and calling police and providing details like truck description ,time of day,direction of travel etc. In an ideal world and situation. Encountering him on limping - trip back home must have set off primordial instincts. Hard wired cave man stuff. Hopefully charges will be dropped and then you can go after damages. Make sure your description of truck is spot on with the one you encountered later on. Good luck ,this could take awhile.
 
Oh man splat just more proof its stupid immature dangerous expensive hobby to ride motorcycles even if no fault of your own. Best to go on offensive and counterclaim with charges of assault with *deadly weapon* [truck] and your ***necessary*** acts in pursuit to prevent the criminal from completing his 'planned active escaping' by using only minimal non-injury force. Might want to make friends with a newspaper writer to cover the story to keep some public light on the roaches that are licensed to lie. Oh yeah after similar avoidance crashes my Cdo's tend to develop some loose electrical gremlins. Stuff like this both from man and animal have caused me a FIRM habit of hanging close to edge paint line around and over EVERY Blind no matter how fast or slow I'm going and still don't know how to react mentally-emotionally to the routine instant close death calls too fast to actually react too.

This happened on a remote but reasonable busy road, police would have been atleast 45 minutes away, if they turned up at all, no witnesses, after talking to the police for 45 min 2 more'' green trucks carring white bulk liquid containers '' pulled up and stopped with their mate, yes that's the truck officer, the green one with the big white vessel on the back. Wheres the trucks with the road cam when you need it?, maybe it will turn up when the police lay a dangerous driving charge against him.
 
Good on you though for persisting to a 1 on 1 confrontation with this idiot. He knew he was caught this way and what he said and his actions should prove his guilt. It's unlikely another another green truck with white container got between you or you would have noticed I think. You might insist your actions were somewhat to prevent another serious accident as he was still hogging the whole road even afterward. I wonder what his driving history is, how long he has been driving those type trucks etc. He should have been charged with leaving the scene of an accident for sure and possibly dangerous driving.

Now that the adrenalin has wore off got any aches and pains as a result?
 
Get written quotes, and photos of the damage involved.
And forward to the trucking Co involved.
Keep copies for your records, and for the 'assault' hearing(s).

And keep us posted here.

Make sure you add that "failed to stop after causing an accident" phrase somewhere in every sentence you write or speak on this matter.

I'm afraid the old anti-biker bias is still alive and well. It can be overcome or you can walk right into it with a can of gas and set yourself on fire. A very similar incident happened here in the USA this morning. Made the national news. It was totally mismanaged by the guys on bikes. They're now in jail. The media left out the early reports that the guy in the SUV intentionally hit a guy on a bike after supposedly being cut off, ran over him breaking his legs, and left the scene. It was what prompted the chase of the guy in the SUV by the guys on the bikes in the first place.

Before you get pissed off at me , I've been there. When I was a kid I was riding to work in downtown L.A., AM rush hour. Surface street, four lane, no parking in right curbside lane. People still do, me in the left lane guy pulls up in the right lane wanting to pass me. Flips me off, screaming. I flip him off back. He slams into me knocking me into oncoming traffic. Nobody hit me. I'm on the ground with the bike in top of me. The guy's 30-40 up the road. He puts it in reverse burning rubber. Changed his mind for some reason, I think someone interceded.
I learned that you will never win an argument with someone in a car, and even though it's up front and personal on a bike in ways that people in cars can't get, you're going to set yourself up to lose if you don't keep it together.

this is serous situation and likely evidence will be sought on any claims of vehicle contact. In your face run out lane off the road should be enough and fleet scene of an accident. Maybe the truck was GPS equiped to get that record of which truck driver was where at the time and maybe wayward speed or direction too. I've seen photo's of rider helmet embedded in a truck grill till crew removed the body and bike, so at least still alive to fight your way to the other side. Pretty cave man to pick back up and unbend stuff and catch back up and have at it.

Maybe something happened prior but the footage I saw showed a bike pull in front of the SUV and brake check it to the point the SUV bumped the back of the bike.
The bike riders then started pounding the SUV with with the guy,wife and small child inside,he then did what most people would do and tried to leave the scene for their safety.
The consensus on a bike site down this way favoured the driver.
There are to many video uploads of bike riders running riot on US roads,you pull those stunts and someone will get hurt eventually.
Blocking all lanes = douche bags. (imo) be that wannabe HD riders or those on rice burners.

Good luck Splatt,if the truck driver ran you off the road and then left the scene they deserve all they get.

Ging for a spin on a quite drizzley Sunday , 25 miles ' around the block ' , in the sticks - some #%^? :x etc in one of them , 300Hp supercharged diesel ,
mid mounted , decides its time to do likewise , but in the opposite wise , clockwise even . Full Weelie , 4 wheel drifting through the bends . useing ALL
the road . ( probly the only two vehicals ON the Road . :( Approaching the Blind humped right hand entry to the one way bridge , the ' oh dear feelings grown , and Ive slowed down to 15 mph , when this thing hurtles out of the bend , drifting , useing the whole of the road . Hard left onto the dirt for me .

If I hadnt had the caution attack , the next 60 yars were inescapeable ' hood onrnament ' territory . Unless you went under the wheels . :!:

Out to the higway , quitely down , and out the other loop , approaching the blind banked tightest turn , by the fence that drops to the stream ,
I again get cold feet ( actually it was a cold day , the hands , feet & a few other things were cold too - But a nice dull day for a quiet trundle ) .

AND button off well back , slow down , and hold left ( left lane driveing in N.Z. ) When OUT OFF THE CORNER , hurtles the 4wd fwd control
Orchard Spreader with our buding fustrated full tit mostachioed farm hand in charge , throttle floored , drifting the bend USEING the ENTIRE Road ,
whereapon yours truely again takes to the verg to escape being road kill , despite bearing no resemblance whatsoever to the farmers best friend , The POSSUM .

as Id also stood it up & pulled the Elbow In . Cattle trucks , Milk Tankers , And Harvey the school bus driver , all expected fellow road users to be elsewhere , when they ' owned the road ' , or to Use the Ditch .

Things have changed in N.Z. , - BMWs even give way to you on pedestrian crossings . Though well dressed woman still expect you to jump clear , if your hich hikeing on Rural Roads . As anybody walking should expect to not be taken notice off . At least untill they get to the Pub / Bar . :?

After experianceing repeatedly the tendancy ' might is right ' as far as occupation of higways & byways was concerned , Id found not only THEY were entitled to bear homicideal tendancies . looking atem comming , averting their path and attentions , they Expected YOU to clear out - on demand .HOWEVER , :D
if you reciprocated , and STEERED TOWARD THEM , somehow it upset their equalibrium , this is on open aspect roads with reasonable visability .

THEY would Flinch , and steer for the ditch . Despite the fact YOU were on a motorcycle .

This presented a quandry , as milktankers and cattletrucks Dont Go Well , in ditches . And wasnt a sight I wished to behold . So left us no further ahead really .Other than if you adopted offensive rather than defensive tecniques , the flinch would show theyd SEEN YOU , and would then Hold Their Lane ;
rather than running you off the road . You can imagine the concern where a Kenworth is Avoiding the Path of a Norton .

Seems to be the Eye Contact / subconcious ' Im bigger than you ' IF you dont possition yourself to Command the Road & advatages. out in the boondocks .

Though beerswilling arogant ignorant immature mobile attitude problems DONT neccesarilly comply to this theory . Out there one ALWAYS should be ready
to immediatly avail oneself to the deristriced fields . Of course avoiding the fenceposts in transit . Unfortunately .

And any car driven by a Woman with young children aboard is likely beyond reason , and again best avoided by adequate margins .

And there were several impartial witnesses who stated " He did that deliberately " ) I replied to their letter ;

' I would be very intrested in the circumstances in which YOU consider ME responsable for damadge to your clients vehical , and perhaps you would like to see a bill for repairs for the damadge to my Norton Motorcycle ' .

My thoughts exactly - in your shocked and distressed state you had no option but to escalate the situation following his totally unreasonable refusal of your initial request to stop and exchange details - after he had failed to stop after the original incident... which only served to stimulate your anxiety state.

You may end up having to swallow the charges against you, but there's strong mitigation, and it shouldn't prevent you seeking redress for his actions - which started with him using his vehicle as a weapon - more than once.

I do think that when the facts are established, the trucker has more questions to answer than you. We just have to hope that the police do their job properly.

can you get photos of where the bike ploughed it's furrow?

Something did happen. I had Morning Joe on the TV, they had running coverage as it developed. When it first broke the commentator said they had third party witnesses' statements saying that the SUV driver had hit a rider, knocked him to the ground, ran over him, then took off. Over the commentary they were showing the footage of the guy surrounded by bikers trying to stop him in traffic. It was interesting to see how the availability of good video footage determined the thread of the story and the conclusions the commentator reached. They dropped any mention of the injured rider and the reason the bikers were after this guy in the first place. The final coverage was Joe Scarborough having a fit yelling, "Where are the cops?", over the pictures of the guy trapped in his car before the bikers dragged him out.

I identify with bikers when I hear about a rider getting hurt, whether or not there are cars involved. But it gets hard when people handle themselves in such a f#*@ing idiotic manner as this. If it's one on one like Splatt I can understand it. I've been there and I know what he was feeling and a judge is probably going to understand it too. But even bikers are going to have a hard time excusing what those guys did.
 
I saw that on the news and felt disgusted that those clowns were on motorcycles, (or does that just make me a hypocrite), I HAVE HAD GOOD AND BAD NEWS , BIKES STILL BENT,police dropped assult charge, but also said they didn't think they would be able to prosecute the driver due to lack of positive ID at scene, but the trucking company seemed genuinely concerned about his driving ,so we will have to see how we get on

Well that's something!
You clearly positively ID'd the haulage firm - perhaps they'd confirm how many trucks they had in that area at that time?
It could be argued that they bear ultimate responsibility, whoever the driver was.
Evidently plod are looking to distance themselves from this one, but their justification seems weak, to say the least - the driver you 'no longer assaulted' was definitely the one who ignored your right of way at a pedestrian crossing, after all....
A 'without prejudice' payment for your dues would seem to be the sensible way forward - perhaps you know a friendly solicitor?
