Yes this is correct. You either fight for every inch of trademark ownership or you are no longer considered legally the owner and cannot got after bigger infringements. Lax assertion of your ownership rights will be used against you in future cases.

The sad thing is, we are trying to keep these old machines running....any company/individual that wants to support this can be discouraged by these legal maneuvers and many never proceed...the parts suppliers can then dry up entirely and the bikes fade away.
When I worked for Harley-Davidson the Motor Company went after every trademark and copyright infringement down to Mom and Pop shops with a Bar & Shield painted on the shop wall. Believe me, there are a lot of people trying to keep the older Harley's on the road. H-D says they treasure their heritage but they only care about sales. That trademark is H-D's bread and butter.
 
Could RGM and Norvil continue on but without the logo? Is it the logo that trademarked or is there more to it than just that? I would not like to see a monopoly develop over spares, etc. What about Colorado Norton? Would they have to drop the "Norton" out of the name? And then there the whole subcontinent painting "Norton" on tanks and side covers. That would be hard to chase down amongst a billion people.
