So, when someone breaks into your home or business and threatens you or your family do you need a referee?
Here you break into a persons home and you get hurt or killed it's your fault and if a person is an accomplice, say a get away driver, he or she is just as guilty as the perp.
We have a saying, "An armed society, is a polite society" .

Yes, you will be judged firstly by the police who will investigate if you reacted proportionately ie enough so you did not get killed yourself but no further, then they will pass on to the Crown prosecution office to decide if it is in the public interest and then possibly finally a Jury decides.

In the heat of the moment you are likely to go over the top, do not know if that is taken into account but this would be for the jury to decide.

In London a 78 year old age pensioner stabbed a burglar with the screwdriver after the burglar had threatened him and his wife with the burglar's own weapon, he was held for 24 hrs for questioning but released and cleared after a public outcry. However he then had to be rehoused under witness protection after the burglar's family threatened him.

We live in an egalitarian culture. Too many embrace equality of result as opposed to equality if opportunity. Envy is tolerated. Theft is envy acted upon. Property rights are denigrated because envy is not condemned.

Back to Ebay and the mess with the Ariel. Found out yesterday that the reason the judge won't sign off on the subpoena was that my friend who has had the bike for over 20 years, never bothered to put it in his name! He has asked me to see if I can get a duplicate. I have tried but they want to verify the vin number which is difficult because it is missing. I did contact AZ Dot and like I said they need to inspect it. I have explained it to them in an email and haven't heard back. I didn't hear back for them the first time for over a month. I have asked them IF they could look it up by my name and address, we will see.
So, if you get a bike put it into your name right off the bat and keep the toys in a secure place.

I should count my blessings. Every eBay mc transaction I’ve been involved in has been honest and rewarding. I think our community is for the most part small and enthusiastic enough to make it work.

At least I hope so since I’m buying a Matchless this week on little more than some good phone conversations, some heavy googling of the seller and a VIN check of the NCIC database ( which doesn’t seem that rigorous).

Progress is being made. Got paperwork back from AZ yesterday with the title number. On the phone, well hold actually, right now to see when I will get the actual title in my hands. Contacted my friend in NM and he has forwarded the info to the detective who is taking that to the judge for him to sign off on the subpoena.

Just got off the phone with Az DOT the actual replacement title is 6 weeks out. We can only hope the judge will be OK with the information supplied by them and doesn't need a copy of the actual title.

This thread, while different from my situation, is a good example with my frustration with living here in a rather overly liberal and hypocritical Massachusetts.
While Mass is in the USA, I am very much starting to regret having wasted 20 years of my life for this country, state and town. Treasonous statement? Do you all feel justified in having sponsored me and my small USAF team having killed probably thousands of Vietnamese. They never did anything to me!
Stealing? Yes my neighbor "stole" , by fencing off a piece of my property, at the protection of a town cop acting on her lies. His having a gun and handcuffs while telling me of the silly things the "good ole boy" towney female told the cop in private. How many times are you going to "argue" to protect your surveyed property before you get a 9mm put in your face? or cuffs and a free ride to jail? At 3 I quit. Formal complaint in writing to the police dept got me zip.
Both the neighbors AND "good ole boy" town government are my motivation to sell and move.
The town "fence viewer" has the state legal authority and responsibility to arbitrate the fence. Fee is nominal but they (town manager & board of selectman) refuse to do their job..
"It's a civil matter" not criminal...
So Above the $2000 I spent for initial survey AND marking with stainless steel poles, now it's required an additional $7000 land court quality resurvey , 2 years wait to get into land court, and $10,000 to $20,000 in legal costs to defend my property?

How bad do I want to live here in a "good ole boy" town? ZERO

NO BODY ever said "thank you for your 20 years of USAF service", until I was in the process of buying this property in 2010. I retired in 1990!

Both my parents were Canadian, so technically I'm Canadian by right. Hummmmm?

I have always thought Canadians were polite courteous friendly and helpful. Has to be a downside somewhere, are they taxed to death?, over the top on environmental stuff?.

After the survey, pay some college kids to move the fence. Cheaper and their move.

Or, 175 an hour for a Bobcat and make them do the surveys to prove their case.

Up date. Got the title and forwarded it on to my friend in NM. He copied it and sent it to the Detective who got the subpoena and it is now on NCIC and Ebay has responded to the subpoena. Progress is being made.

Well it has been an interesting few weeks. The perp is known and there was a hearing 2 weeks ago but the defense asked for a continuance , I expect they weren't prepared. Yesterday he emailed me and said the DA and judge did a plea deal without my friends knowledge or approval. The bad guy pleads guilty to felony theft but gets probation, no restitution and no information on where the Ariel and other bikes are! It might be that the bad guy paid his lawyer with the proceeds from his theft! Lawyers, no wonder that people hate them.
I expect that the deal was a quick and expedient way to clear the case and make sure the bad guy doesn't go to jail and possible catch coved19.

A rope and tree would have better served justice in my opinion. Allow the judge to go fishing and the lawyer to chase an ambulance..... SNAFU as owner is screwed no matter what.

Got an email from my friend in NM. It's all over but the crying. The perp pled guilty got no jail time, no restitution, no info on where the missing bikes are, no info on whom told the perp who told him about the bikes. The perp didn't even show up for the hearing just his lawyer. I expect the judge, DA and defense attorney all went out for beers afterwards.

Had a bike stolen from my back yard 5 years ago, padlock and chain lock cut with bolt cutters steering lock jammed so it could be moved. To cut a long story short, it was found in a local forest where the thieves couldn't start it, so they set fire to it, ruining the bike. 10 months later the police caught a lad who lived 15 miles away, and he admitted to stealing no less than 4 motorcycles/scooters, and was given 12 months.
7 months later, as he had done 50,% of his sentence, he was released, my shed was broken into. It almost looks as if crime pays. . . . . . .

Be careful.... because if you prevent them from stealing they'll take to rioting and wreck a country.
